TERMS OF SERVICE AGREEMENT
This website is operated by Empower Charter School (‘Empower Language Academy’ ‘we,’ ‘us,’ or ‘our’).
PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY.
BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES.
THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 01/28/2026.
ACCEPTANCE OF TERMS
The following Terms of Service Agreement (the “TOS”) is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with Empower Charter School, also known as Empower Language Academy, located at 6484 Linda Vista Rd, San Diego, California 92111 and our subsidiaries and affiliates, in association with the use of the Empower Charter School website, which includes https://empowercharter.org, (the “Site”) and its Services, which shall be defined below.
DESCRIPTION OF WEBSITE SERVICES OFFERED
Empower Language Academy (the “Site”) is the official digital platform for Empower Charter School, a non-profit, tuition-free public charter school based in San Diego, CA. The Site serves as a comprehensive resource for current and prospective families, educators, and community members.
The primary purpose of the Site is to:
Resource Access: Provide official school policies, handbooks, and mandatory public disclosures (such as WASC accreditation and Title IX information).
Educate & Inform: Provide detailed information regarding our Spanish dual-language immersion program, inquiry-based academic curriculum, and holistic fitness-focused education (including our CrossFit Kids program).
Facilitate Enrollment: Offer digital tools for school inquiries, campus tour scheduling, and student enrollment applications.
Engage the Community: Host school news, event calendars, and portals for parent involvement (PTO, board meetings, and volunteering).
How the Site Operates
The Site functions as an interactive informational hub. By accessing the Site, users engage with its operations in the following ways:
A. Information & Content Delivery
The Site is operated and maintained by Empower Charter School. We provide “As-Is” access to educational content, news, and media. While we strive for accuracy, the Site is updated periodically to reflect changes in school schedules, state mandates, or academic policies.
B. User Interaction & Data Collection
Users may interact with the Site through:
- Contact & Inquiry Forms: Collecting names, emails, and phone numbers to respond to specific questions about the school.
- Newsletter Subscription: An opt-in system for receiving school updates and tips.
- Enrollment Portals: The Site may link to third-party secure platforms for the submission of sensitive student enrollment data, which is handled in accordance with FERPA and our Privacy Policy.
C. Communication Services (SMS/Email)
The Site offers users the ability to opt-in to communication services. If a user provides a mobile number, the school may operate an automated messaging system to provide:
- Appointment and tour reminders.
- Urgent school notifications or scheduling updates.
- Upcoming student events and reminders
- Attendance information
- and other important school information
D. Third-Party Links & Governance
The Site operates as a gateway to other essential educational tools (such as student grade portals or donation platforms). While these are integrated into our operations, users are subject to the terms of those specific third-party providers.
E. Regulatory Compliance
The Site operates under California and Federal laws governing public charter schools. This includes adherence to the Children’s Online Privacy Protection Act (COPPA)—meaning we do not knowingly collect personal information from children under 13 through the public-facing website—and the Uniform Complaint Procedures (UCP) for reporting grievances.
Any and all visitors to our site shall be deemed as “users” of the herein contained Services provided for the purpose of this TOS.
The user acknowledges and agrees that the Services provided and made available through our website and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Empower Charter School.
At its discretion, Empower Charter School may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified or revised Services unless otherwise stipulated. Empower Charter School does hereby reserve the right to cancel and cease offering any of the aforementioned Services and/or products. You, as the end user acknowledge, accept and agree that Empower Charter School shall not be held liable for any such updates, modifications, revisions, suspensions or discontinuance of any of our Services and/or products. Your continued use of the Services provided, after such posting of any updates, changes, and/or modifications shall constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in effect. Should you not agree to the updated, revised or modified terms, you must stop using the provided Services forthwith.
Furthermore, the user understands, acknowledges and agrees that the Services offered shall be provided “AS IS” and as such Empower Charter School shall not assume any responsibility or obligation for the timeliness, missed delivery, deletion and/or any failure to store user content, communication or personalization settings.
PRIVACY POLICY
Every user’s registration data and various other personal information are strictly protected by the Empower Charter School Online Privacy Policy (see the full Privacy Policy at https://empowercharter.org/privacy-policy). As a user, you herein consent to the collection and use of the information provided, including the transfer of information within the United States and/or other countries for storage, processing or use by Empower Charter School and/or our subsidiaries and affiliates.
SMS Messaging Consent
By providing your mobile phone number, you consent to receive SMS or MMS messages from Empower Charter School, which may include:
- Appointment and tour reminders.
- Urgent school notifications or scheduling updates.
- Upcoming student events and reminders
- Attendance information
- and other important school information
Message frequency may vary. Consent to receive SMS messages is not a condition of purchase or receiving services.
These SMS and MMS Terms and Conditions (“Terms”) govern the use of mobile messaging services (the “Service”) provided by Empower Language Academy (“we,” “us,” or “our”) to subscribers who opt in to receive SMS and/or MMS messages from us via a 10-digit long code (10DLC) number. By opting in to receive SMS/MMS messages from us, you agree to these Terms and our Privacy Policy.
Message Program Description
We use SMS and MMS messaging to send updates such as:
- Appointment or event reminders
- School or organizational announcements
- Emergency notifications
- General informational messages
Message frequency varies by user and preference. Standard message and data rates may apply.
Opt-In Consent
You agree to receive SMS/MMS messages from Empower Language Academy by:
- Submitting a phone number via a web form, application, or paper form
- Checking a consent box or clicking a confirmation button when prompted
- Texting the keyword YES or SI to (858) 292-1304
- Consent to receive messages is not a condition of any purchase.
Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you may receive one final confirmation message. To resume receiving SMS messages, reply START.
Message and Data Rates
Standard message and data rates may apply from your mobile carrier. Check your mobile plan and contact your wireless provider for more details.
Message Frequency
Message frequency will vary depending on your preferences and interactions with us. We strive to keep messages relevant and timely.

CAUTIONS FOR GLOBAL USE AND EXPORT AND IMPORT COMPLIANCE
Due to the global nature of the internet, through the use of our network you hereby agree to comply with all local rules relating to online conduct and that which is considered acceptable Content. Uploading, posting and/or transferring of software, technology and other technical data may be subject to the export and import laws of the United States and possibly other countries.
